The Parish Council voted at their meeting on Tuesday evening to explore the opinions available to us to try and reject the planning permission which has now achieved CWAC approval for 15 affordable houses on land adjacent to Higher Heyes Drive. This approval had to be rubber stamped by Secretary for State for Communities and Local Government as it is a "departure" from CWAC Local Plan Part 1.
The Parish Council wrote to the Secretary of State on Wednesday and requested that he "Call In" the application.

Below is the letter they have sent:

Chairman: Cllr. D Crossley

Dear The Rt Hon Sajid Javid MP

Recent approval of planning permission (17/02356/FUL) by Cheshire West and Cheshire Planning (CWAC) for the development of 15 affordable dwellings on land off Higher Heyes Drive, Kingsley, Frodsham Cheshire

Kingsley Parish Council and many of its residents believe that the approval of the application departs from the CWAC Local Plan adopted on 29th January 2015. We do not believe that the decision is in accordance with the policy regarding Rural Exception Sites for the development of “affordable housing” in the Green Belt.

Kingsley Parish Council is now taking legal advice regarding this matter and would seek your assistance by requesting that you “call in” this planning application for public inquiry.

We are advised there is a legal precedent in this matter:

Old Hunstanton Parish Council v Secretary of State for Communities and Local Government [2015] EWHC 1958 (Admin) Before THE HONOURABLE MRS JUSTICE LANG DBE IN THE HIGH COURT OF JUSTICE, QUEEN'S BENCH DIVISION, PLANNING COURT

Thank you in anticipation of your positive response.

Yours sincerely

Parish Clerk

Kingsley Parish Council

cc Alok Sharma MP - Minister of State for Housing and Planning

Samantha Dixon - Leader Cheshire West and Chester Council.

Ralph Oultram – Kingsley Ward Cheshire West and Chester Council
